Can you sue for them not checking your ID? You can sue for anything you want. But to win, you will have to show how you suffered damages from the bank's action, and that the bank is liable for those damages. I don't know about all the details with the account, and why it continues to stay open, so I can't comment on that. But as for not checking your ID, what damage did this cause you?

Of course, if you feel you have a case, you can (and should) contact a lawyer for legal advice. If you are going to try to sue the bank, you will need on on your side anyway. Trying to sue the bank on your own is like a Little League pitcher trying to strike out Babe Ruth. You can bet the bank will have a team of very qualified (and very well paid) lawyers on their side.

You can sue anybody for anything. That doesn't mean you will win.
