that is not your problem, report it as lost or stolen and request a new check be sent to you by mail NOT electronic transfer or you will have the same thing happen again.
they never fix mistakes so you have to change the process in order to get a different result then the last time.
also go to that bank and if they have an account there in your name with your social security number then close the account and withdraw all the funds there.
You know which bank has your money, so it's between you and them, and possibly the other person with the same name. You might need to hire an attorney, or just send the bank a letter with a copy of your tax return.
