If somebody stole my identity and cleaned out my bank accounts, would my bank have to replace the money ? What would have to happen in order for me to be reimbursed ? How long would it take for me to be reimbursed ? Does every bank have its own rules, or is there one set of rules that every bank has to follow ?...

Depends on what state you are in and what bank you are dealing with and how far you went to recover the assets on your own.. Your legal paper trail.

If it is WELLS FARGO BANK, forget about it.

Most banks will reimburse you the [returned items] fees associated with the theft, but they are not responsible for returning your funds.

You should check with your local state bank examiners office to see what the regulations are in your state.

I never check my bank account and my check book was stolen, cloned and a copy of my driver's license was stolen and cloned. I did not check my bank account for 2 months. By the time I checked it, I was missing over $3,900.00. Wells Fargo gave me back $353.00 in returned items fees. They told me that I had to seek legal remedy to recover the principal. I will state further that Wells Fargo was very nasty about issuing a credit for the $353.00. The only time a bank will return the amount stolen is when a bank employee steals money from your account. That has happened to me too and Bank America in Henderson, NC off Norlina Road. The teller stole my entire deposit.

You have to file the appropriate reports with your bank and do it in a reasonable amount of time after it happens. You usually have several weeks past the statement date containing the illegal activity. You would file a forgery claim in the case you present. Depending on the activity, you may have to wait to have the money replaced but they will sometimes give provisional credit.

Be sure you only file these kinds of claims if it's true. I've seen people prosecuted for trying to file fake claims where they had a friend taking the money out.
