Can I sue a credit card company for taking money from my bank account w/o my permission?

I called Newport News Credit Card to make a payment over the phone and the rep told me it was $20 to use the pay by phone service. I told her I will mail it in for free, which I did. They stil $60 from my bank account and said it will take about 14-21 days to get it back. What can I do? I am pissed and overdrawn :(

If the account was over 30 days, they do have that right. It's called the right of set-off. If the account was under 30 days, file a complaint with the Federal Trade Commission @ 1-877-382-4357. All companies must answer to them. Once you get your money back, go to a different bank. You should never have your checking account where you have other accounts with the bank.

Yeah, sure, spend $100 to file the papers to sue them in small claims. LOL

Perhaps you neglected to actually tell the representative you didn't actually want to make the online payment. You are fortunate to be getting it back at all
